    The Climate Change Dimension of Business and Human Rights: The Gradual Consolidation of a Concept of ‘Climate Due Diligence’

    This article makes the case for a ‘holistic’ approach to human rights due diligence, arguing that such a standard must be interpreted in the light of mutually reinforcing principles of environmental law, climate law and human rights law. Through a review of emerging climate change-related litigation, it shows how a concept of ‘climate due diligence’ is gradually consolidating. Building on the United Nations Guiding Principles on Business and Human Rights, the article explores climate due diligence both as a standard of conduct and as a business process, presenting its main features. It argues that corporations should integrate climate due diligence into their processes and policies to be best prepared for likely regulatory and judicial developments, such as the upcoming European Union’s regulation on human rights and environmental due diligence.

      The topic is climate change and it is indeed very important. Sometimes i heard theories that covid19 is an effect of climate change. So the topic is important.

      It is a descriptive study. It describes the process in the making of a new concept called climate due dilligence and it describes the elements of process well. Its methodology is the review of climate change litigation order and building on the United Nations Guiding Principles on Business and Human Rights. The method only focuses on litigation orders but there are many acts, laws, policy and execytive orders on climate change already. A thorough review of all laws, acts, policy, executive orders and litigation orders would be more sound method to know any development or consolidation of climate due dilligence than only reviewing the litigation order.       The references are generally climate litigation in different courts which is not the only way of knowing climate due dilligence. Basically the entire concept is made of court order. There are substantive law or procedural law on climate due dilligence. The references is such because of the methodology chosen. But it shows only a part of the picture and not the whole picture. Without those substantive laws the research cannot be complete.

      Also the references are secondary in nature coming from reports and articles written by other researchers when primary sources are available online. Why not collect and process primary source ?       So the research is less credible and incomplete.

      The article somehow is well made. The logical and structural way of describing the topic makes this article well comprehensive.

      It is an important topic seen in parts well. Part of this important topic is well visible. But if whole of this topic is well visible, it would be better.
