Abstract

La sentencia aquí comentada supone la última declaración por el Tribunal Constitucional de vulneración a la tutela judicial efectiva por parte de los Juzgados de lo Mercantil y de la Audiencia Provincial de Barcelona ante las suspensiones y archivos de causas relativos a las cláusulas suelo. Todo ello a la espera de la resolución de un proceso colectivo sobre cláusulas suelo iniciado en 2010 ante los Juzgados de lo Mercantil nG II de Madrid.

Translated abstract

The ruling discussed is the last determination of the Spanish Constitutional Court about the right to effective judicial protection violation by Commercial Courts and Provincial Courts of Barcelona on the suspension and dismissing proceedings related to floor clauses. All of this while we are waiting for the decision of the collective action against floor clauses filed before the Commercial Court 11 of Madrid in 2010.
