Abstract

O nome de Carl Schmitt está condenado a associar-se à rubrica "decisionismo" jurídico, teoria segundo a qual o fundamento último do direito é uma decisão política do soberano. Este artigo se propõe mostrar como o decisionismo jurídico de Carl Schmitt dos anos 20 modifica-se, sem se tornar contraditório, com a asssimilação nos anos 30 do "institucionalismo jurídico" de autores como Maurice Hauriou e Santi Romano. A partir dos anos 30 Schmitt explicita o sentido próprio do decisionismo fundado no "pensamento da ordem concreta", ou seja, o decisionismo institucionalista.

Translated abstract

Carl Schmitt's name is irrevocably linked to the label of decisionism, the theory according to which the ultimate foundation of right is the sovereign's political decision. This paper aims to show how the juridical decisionism of Schmitt has changed without becoming contraditory as it assimilated in the thirties the '"juridical institutionalism" of authors like Hauriou and Santi Romano. Following those years Schmitt worked out the meaning of a decisionism based on the "concrete order thought", namely, the institutionalist decisionism.
