          Dans cet article on examine la théorie de la démocratie en soulignant son insuffisance à expliquer les jeunes démocraties ainsi que les moins jeunes apparues dans la région nord-ouest du monde. Tout d’abord, on procède à l’analyse critique de plusieurs définitions de démocratie, surtout celles qui, censées suivre les idées de Shumpeter, sont considérées comme minimales ou processuelles, et propose une définition réaliste et plus succinte, mais non pas minimale, du régime démocratique. Ensuite, on examine les connexions de ce thème avec d’autres, comme les droits politiques, civils et sociaux, ou encore l’État dans sa dimension légale et certaines caractéristiques du grand contexte social. De cette analyse se détache la notion d’agency, car on la trouve surtout exprimée, sous diverses variantes ce pendant, dans le système juridique des démocraties actuelles.

          Translated abstract

          The present article is a revision of democratic theory from the perspective of its inadequacies to account for the new - and not so new -, democracies located outside the Northwestern quadrant of the world. It begins by examining various definitions of democracy, especially those that claiming to be Schumpeterian, are deemed to be minimalist, or processualist; and proposes a realistic and restricted, but not minimalist definition of a democratic regime. The connections of this topic with several others are then explored, including political, social, and welfare rights; the state, mainly in its legal dimension; and some features of the overall social context. The main grounding factor that results from these explorations is the conception of agency, as it is expressed in the legal system of existing democracies, although widely variable across cases.

              Constitutions and Commitment: The Evolution of Institutions Governing Public Choice in Seventeenth-Century England

              The article studies the evolution of the constitutional arrangements in seventeenth-century England following the Glorious Revolution of 1688. It focuses on the relationship between institutions and the behavior of the government and interprets the institutional changes on the basis of the goals of the winners—secure property rights, protection of their wealth, and the elimination of confiscatory government. We argue that the new institutions allowed the government to commit credibly to upholding property rights. Their success was remarkable, as the evidence from capital markets shows.
