      The Registration of the Ownership of the Illegal Objects in Albania

          Abstract

          The right of ownership in Albania is one of the fundamental human rights sanctioned on the Constitution. The right of ownership changes with the changes of economic social relations. Together with the tremendous political and economical changes in Albania, there was a great development in illegally obtaining the state property and private property also. After the year 1990, a considerable number of people used the force to keep and protect the property acquired illegally. In these conditions, the legalization was a pragmatic answer against the difficult consequences that came from the occupation of the land and massive population movement onto these lands. The legalization aimed to give ownership of state and private land to people who had illegally constructed buildings and to make them part of the process of urbanization. Legislative initiatives were undertaken and institutions were created in relation to this process. This study aims to present the legal steps and the documentation needed to obtain the title of ownership of the illegal objects and the closure of the procedures of its registration up to the final step of acquiring the certificate of property. This study presents a series of legal and judicial norms and their analysis in the view of respecting the right of ownership, and by giving suggestions that help the finalization of the process, in order to harmonize it with guaranteeing of the property right to the legitimate owners.

          Communication and Ethical Behavior in the Public Service

          Setting up public administration which operates effectively and taking over responsibilities, both crucial on the point of view of the democracy indicators, requires great effort from all social stake holders in setting up and maintaining a public service organization. This notion implies the setting in function of the instruments and procedures that prevent undesirable behavior and provide encouragement of good behavior among operators of those services. While doing this, communication as a main component of the public service, calls for structure and control. Ethics or standards of behavior in the public sector are important political and public issues for every country, which is always held as a fundamental prerequisite for “good behavior” (good governance). The Code of ethics by which are expressed the values and standards in the civil service is one of the ethical elements of infrastructure. It enhances the function of orientation (giving instructions for action and behavior), and aims: respect for the law, respect for individuals, personal and professional integrity and efficiency in managing public resources, reinforcing the role and importance that the communication strategies and tools have. Professional association helps to develop judgment and of the necessary skills to enable white collar workers to apply communication strategy and tools and ethical principles in real circumstances. Objective progress can help create an environment where the white collar workers are willing to face and resolve communication problems and ethical disputes, they can even develop essential skills for effective communication and ethical analysis. The mechanisms of awareness about mission and processes of the public service, orientation and internal consulting in the civil service should be available to help white collar workers to apply basic communication and ethical standards in the workplace. Improvements in the legal framework is necessary for the proper functioning of public service, namely: to gain and maintain public confidence.

            Civil rights between legal provisions and political reality in Albania

            One of the basic principles of civil rights is that all human beings are born free and equal in dignity and rights. The life protection, liberty and property should be equally guaranteed to citizens to exclude discrimination of minorities or other parts of the population. These rights are an important part of civil liberties and are considered as an essential element for effective citizenship. Arbitrary arrest, terror, torture or other serious and unlawful interference, both by state and private actors, significantly affect the well-being of democracy as it affects the very essence of it. In liberal democracies, leaders legitimized by the people must be involved within the norms and principles of the rule of law in order to establish a healthy relationship between the state and the citizen. This relationship is considered to be damaged in non-liberal democracies as it is affected by the suspension of individual freedoms and rights. This paper aims to analyze whether these individual rights are guaranteed and protected in Albania, considering from the perspective of the legal framework as well as in the political reality. This study aims to analyze the development of human rights, judicial rights and their implementation in our country to come to the conclusion, whether our system is that of a liberal democracy or not.
