Abstract

En este ensayo quiero mostrar un análisis de la obra de Carl Schmitt concentrándome en dos conceptos básicos: la paradoja de la excepción y su juridificación. En mi opinión, el análisis de Agamben deja de lado un aspecto importante de la obra de Schmitt: su concepción de la excepción y la teoría del orden concreto como el modo de resolver la aparente paradoja de la excepción. Esto se ve a través de un estudio detenido de la transformación que sufren las ideas de Schmitt desde su estudio de la dictadura hasta su estudio sobre el nomos de la tierra.

Cet essai montre une analyse de l'ouvre de Carl Schmitt, particulièrement autour de deux concepts : la paradoxe de l'exception y leur juridisation. On montre que l'analyse d'Agamben sur Schmitt laisse de côté un sujet très important : la conception de l'exception et la théorie du ordre concret comme un moyen pour résoudre la paradoxe de l'exception. Il faut étudier la transformation de la pensée de Schmitt dés l'étude sur la dictature jusqu'à la réflexion sur le nomos de la terre.

In this paper I want to show an analysis of Schmitt's ideas, focusing on two of his central concepts: the paradox of the exception and the juridification of the exception. It is my claim that Agamben's analysis of Schmitt misses one important aspect of his work, that is, his conception of the exception in Schmitt and the theory of the concrete order as the way to solve the paradox of the exception. I will do this by analyzing the transformation on Schmitt s ideas since his analysis of the dictatorship to his study of the nomos the earth.
