Abstract

Resumen: Este artículo plantea la necesidad de examinar el origen, conformación y funcionamiento del Poder Judicial de la insurgencia mexicana, no sólo desde los textos constitucionales y la norma escrita; sino a partir del estudio de los ministros y jueces que integraron dicho tribunal en el pueblo de Ario en marzo de 1815, de sus prácticas jurídicas y de su propia concepción del derecho, marcados por una época de transición política. Como paso indispensable para emprender dicho estudio, sometemos a examen a los autores y obras que en distintas épocas se ocuparon de los ministros del tribunal; destacamos su origen y formación profesional, las motivaciones que los llevaron a escribir sobre ellos, analizamos sus contenidos, advertimos sus errores y confusiones, pero también valoramos sus contribuciones al conocimiento de la corporación.

Résumé: Cet article croit nécessaire d'examiner l'origine, la formation et le fonctionnement du Pouvoir Judiciaire de l'insurrection mexicaine, non seulement du point de vue des textes constitutionnels et de la norme écrite, mais aussi à partir de l'étude des ministres et juges qui intégrèrent ce Tribunal dans le village d'Ario en mars 1815, ainsi que de ses pratiques juridiques et de sa conception du Droit marquées par une époque de transition politique. Etape indispensable pour mener une telle étude, nous examinons d'abord les auteurs et œuvres qui à diverses époques s'intéressèrent aux ministres du Tribunal ; nous soulignons leurs origines, formations professionnelles et motivations, analysons leurs contenus soulignant au passage les erreurs et confusions, mais valorisons également leurs contributions à la connaissance de la corporation.

Abstract: The purpose of this article is to examine the origin, conformation and operation of the Judicial Power of the Mexican Insurgency, based on not only constitutional texts and the written law, but also on the study of ministers and judges who appertained to that tribunal in the Ario town in March, 1815. Furthermore, their legal practices and their own understanding of the law are also taken into account, both of which are marked by an era of political transition. As an important step to begin the study, we examine the authors and written works who dealt with the tribunal in other periods. In addition, we highlight their origin and vocational training, the motives that led them to write, we analyze their contents, we notice their mistakes and confusions, but we also appreciate their contributions to the knowledge of the corporation.
