EL DERECHO DE UNA VIVIENDA ADECUADA I: PROPUESTA SOBRE CÓMO MEDIR EL CUMPLIMIENTO DEL ASPECTO "LUGAR" Translated title: THE RIGHT TO AN ADEQ UA TE HO USINGI: A PROPOSAL ON HOW TO MEASURE THE COMPLIANCE WITH THE ASPECT "LOCATION"

Abstract

A pesar de que no hay debate jurídico sobre la obligatoriedad del respeto y garantía de los derechos económicos, sociales y culturales, aún existen muchas dificultades para la medición de su cumplimiento. Como consecuencia de lo anterior, garantías como la obligación de progresividad, en su componente mínimo y en su apreciación hacía adelante, se vuelven ineficaces. Por tanto, es imperativo el desarrollo de análisis interdisciplinarios que permitan construir metodologías para la medición del cumplimiento de la garantía de estos derechos. En este caso, el "derecho a una vivienda adecuada" que, como lo ha señalado el Comité de Derechos Económicos, Sociales y Culturales de la ONU, tiene diversos aspectos, entre otros, habitabilidad, seguridad jurídica de la tenencia, disponibilidad de ciertos servicios y el aspecto "lugar". Este artículo, tiene como propósito presentar una metodología que permita medir, satisfactoriamente, el aspecto "lugar". Por las limitaciones de espacio, sólo me refiriré a los posibles indicadores y aplicación. Esta metodología, está siendo desarrollada por el autor, como consultor de la Defensoría del Pueblo, ente estatal colombiano dedicado a la promoción de los derechos humanos, que a través de su programa ProSeDHer busca la creación y divulgación de herramientas para su mejor garantía y respeto. Se utiliza a la ciudad de Bogotá como referencia, debido a que, actualmente, el objeto de evaluación de la Defensoría del Pueblo son los proyectos de vivienda de interés social y de vivienda de interés prioritario en desarrollo en las áreas integradas al perímetro urbano que pertenecían a las zonas de expansión del sur y borde occidente.

Translated abstract

Even though there is no legal debate regarding the existence of the international obligation of respect and guarantee of economic, social and cultural rights, there are still many difficulties on the measuring of the compliance of said obligation. As a consequence of the later, guarantees such asprogressivity, in its basic and minimum expression, as well as in its appreciation in the future, become ineffective. Therefore, the development of interdisciplinary analysis, which allow the construction of methodologies for the measuring of the compliance with the guarantee of said rights, is imperative. In this case, the "right to an adequate housing" which, as has been indicated by the Committee on Economic, Social and Cultural Rights of the UN, CESCR, has diverse aspects, among others, habitability, legal security of tenure, availability ofservices, materials, facilities and infrastructure, and location. This article has the purpose of presenting a methodology which will allow to measure, adequately, the aspect "location". Nonetheless, because of the space limits, I will only refer to survey figures and their application. This methodology was developedby the author as a consultan t of the Defensoría del Pueblo (Colombian Ombudsman), which is a state entity dedicated to the promotion of human rights, and which, through its program ProSeDHer is looking to create and divulge the measures for improving their respect and guarantee. The city of Bogota is used as a reference, given that the object of evaluation of the Defensoría del Pueblo are the projects of "vivienda de interés social y de vivienda de interés prioritario" as a development of the expansion areas in said city.
