Abstract

In light of the crises that are occurring in the world, a question arises about its implications on justice in general and criminal justice in particular, and the impact of criminal policy on the consequences of the global crisis that may sweep across various areas. This study, which follows the descriptive analytical approach, aims to clarify the concepts related to the global crisis and its repercussions on criminal responsibility, as well as the accompanying developments of crimes to show the extent to which criminal justice is effective and appropriate, whether through legislation or judicial application. The study also discusses the trend towards activating alternative punishments that deviate from the traditional penal system sphere, and the required amendments on the rules of criminal procedures, whilst preserving the main structure of the criminal law represented by the principle of legality and trial guarantees Fairness, and expanding the concepts of criminal reconciliation and the effective and positive application of stopping punishment.

في ظل الأزمات التي تطرأ على العالم؛ يثور التساؤل حول انعكاساتها على العدالة عمومًا والعدالة الجنائية خصوصًا، ومدى تأثّر السياسة الجنائية بتبعات تلك الأزمات العالمية التي تجتاح مختلف الأرجاء، فجاءت هذه الدراسة التي تتبع المنهج الوصفي التحليلي بهدف توضيح المفاهيم المتعلقة بالأزمة العالمية وانعكاساتها على المسؤولية الجنائية، وما رافقها من استحداث جرائم لإظهار مدى تمكن العدالة الجنائية وملائمتها؛ سواء من خلال التشريع، أم التطبيق القضائي، والاتجاه نحو تفعيل عقوبات بديلة خروجًا عن بيئة النظام العقابي التقليدي، وما يتطلب من تعديل قواعد الإجراءات الجنائية، مع المحافظة على البنية الرئيسية للقانون الجنائي المتمثل في مبدأ الشرعية، وضمانات المحاكمة العادلة، والتوسع في مفاهيم المصالحة الجنائية، والتطبيق الإيجابي الفعّال لوقف العقوبة.
