          Abstract

          ABSTRACT This paper explores some of the institutional factors that guide the environmental action of municipalities in Brazil. The starting premise is that there are particular institutional factors that empower the Brazilian state and society, guide processes and provide a unique profile to local environmental policy. Regulations for environmental protection are analysed from a historical perspective, taking into account the federal organization of the Brazilian state and its particular distribution of powers. Five factors emerge as the driving forces behind the actions taken by municipalities in relation to the environment: the federal status of municipalities, the inclusion of the environmental protection provision in the Federal Constitution, the lack of consistent funding for environmental policy, the coexistence of several regimes within environmental rules, and the discretionary power, held by environmental bureaucracy, related to the indeterminacy of environmental regulation.

          Resumo Neste artigo são analisados, em caráter exploratório, fatores institucionais que balizam a ação dos municípios brasileiros no campo ambiental. Assume-se como ponto de partida que determinados condicionantes institucionais habilitam Estado e sociedade para a tutela da qualidade ambiental no Brasil, balizando processos de políticas públicas ambientais e definindo singularidades do exercício do mandato ambiental na esfera municipal. A análise aborda regulações ambientais de abrangência nacional em perspectiva histórica, à luz da organização federativa do Estado no Brasil e da distribuição entre esferas de governo. Cinco fatores se destacam como forças motrizes das ações municipais no campo ambiental: o status dos municípios enquanto entes federativos, a inclusão do tema ambiental na Constituição federal, a ausência de provisões para garantir fontes estáveis de financiamento da política ambiental, a coexistência de diversos regimes jurídico-institucionais na moldura institucional ambiental, e o poder discricionário da burocracia ambiental, relacionado à indeterminação da norma ambiental.

          Políticas sociais no Brasil: descentralização em um Estado federativo

          O artigo analisa o processo de descentralização do Sistema Brasileiro de Proteção Social, identificando sua extensão e variação e os fatores que determinam o formato que este vem assumindo. O objeto da análise é a descentralização de cinco políticas sociais - saúde, habitação, saneamento básico, assistência social e educação fundamental - em seis estados brasileiros - Rio Grande do Sul, Paraná, São Paulo, Bahia, Pernambuco e Ceará. O trabalho examina a importância dos seguintes fatores para explicar a extensão e a variação da descentralização: (a) os atributos estruturais das unidades locais de governo - capacidade econômica, fiscal e administrativa -; (b) os atributos institucionais das políticas - regras constitucionais, requisitos de engenharia operacional e legado das políticas prévias - e (c) os fatores ligados à ação política - relações entre Estado e sociedade e relações intergovernamentais.

            A coordenação federativa no Brasil: a experiência do período FHC e os desafios do governo Lula

            O renascimento da federação brasileira com a redemocratização trouxe uma série de aspectos alvissareiros, mas o Brasil também precisa enfrentar os crescentes dilemas de coordenação intergovernamental constatados internacionalmente, de acordo com as especificidades históricas de nossa realidade. O presente artigo concentra-se basicamente no estudo dos problemas e ações de coordenação federativa ocorridas recentemente no Brasil, mais particularmente no período governamental do Presidente Fernando Henrique Cardoso. A partir desta análise, procura-se, ao final, apresentar resumidamente os desafios de coordenação intergovernamental colocados para o governo Lula.

              Downgrading, downsizing, degazettement, and reclassification of protected areas in Brazil.

              Protected areas (PAs) are key elements for biodiversity conservation and ecosystem services. Brazil has the largest PA system in the world, covering approximately 220 million ha. This system expanded rapidly in the mid-1990s to the mid-2000s. Recent events in Brazil, however, have led to an increase in PA downgrading, downsizing, and degazettement (PADDD). Does this reflect a shift in the country's PA policy? We analyzed the occurrence, frequency, magnitude, type, spatial distribution, and causes of changes in PA boundaries and categories in Brazil. We identified 93 PADDD events from 1981 to 2012. Such events increased in frequency since 2008 and were ascribed primarily to generation and transmission of electricity in Amazonia. In Brazilian parks and reserves, 7.3 million ha were affected by PADDD events, and of these, 5.2 million ha were affected by downsizing or degazetting. Moreover, projects being considered by the Federal Congress may degazette 2.1 million ha of PA in Amazonia alone. Relaxing the protection status of existing PAs is proving to be politically easy in Brazil, and the recent increase in frequency and extension of PADDD reflects a change in governmental policy. By taking advantage of chronic deficiencies in financial and personnel resources and surveillance, disputes over land tenure, and the slowness of the Brazilian justice, government agencies have been implementing PADDD without consultation of civil society. If parks and reserves are to maintain their integrity, there will need to be investments in Brazilian PAs and a better understanding of the benefits PAs provide.
