          Abstract

          De acuerdo con el sistema federal de 1824, los estados estaban facultados para organizar su gobierno interno y, por ende, lo relativo al ámbito judicial. En ese contexto, los legisladores zacatecanos concibieron la justicia y su impartición en nombre del Estado y bajo la fórmula de la ley, pero ¿a qué ley se referían? La respuesta se ubica en las discusiones del Congreso, sobre la elaboración de un código que resumiera y homogeneizara los cuerpos legislativos y proyectara una justicia legalista. Este proyecto de codificación tardó en proyectarse a causa de la pervivencia de prácticas jurídicas del antiguo régimen en los pueblos, las cuales hicieron inconcebible que un nuevo orden jurídico legalista se impusiera.

          Translated abstract

          In agreement to the federal system of 1824, states were authorized to organize their internal government and, therefore, the judicial thing. In this context, the zacatecanos legislators conceived the judiciary and his imparting on behalf of the State and under the formula of the law, but what law were they referring? The answer is located in the deliberations of the Congress, on the development of a code to summarize and standardize the legislative bodies and project a legalistic justice. This project of codification was slowly to realize because of the persistence of juridical practices of the old regime in the villages that was inconceivable that a new juridical legalistic order was imposing.
