Abstract

RESUMEN: Este trabajo pretende contribuir al incipiente desarrollo de la teoría contemporánea del derecho de contratos en Chile. El derecho de contratos requiere ser justificado políticamente, y la teoría del derecho de contratos cumple un rol fundamental en dicha justificación. El artículo analiza la necesidad de una teoría del derecho contractual, explora su metodología y formula la distinción entre el rol de la dogmática y el de la teoría. Finalmente, se analiza la relación entre ambas.

ABSTRACT: The object of this paper is to contribute to the growing development of contemporary contract theory in Chile. Contract law requires political justification, and contract theory plays a crucial role in such justification. The paper analyzes the need for a theory of contract law, explores its methodology and draws a distinction between the role of contract doctrine and contract theory. Finally, the paper analyzes their relationship.
