Abstract

El artículo discute, sobre la base de un caso que recientemente llamara la atención de la opinión pública, algunos problemas implicados en la atribución de responsabilidad penal en relación con hechos punibles perpetrados por los agentes represivos del régimen militar. Estas cuestiones conciernen, de una parte, la pregunta por la posibilidad de invocar una eximente de responsabilidad genérica, particularmente la de miedo insuperable; y de otra, la pregunta por la posibilidad de invocar una eximente de responsabilidad específicamente referida al hecho de que el agente haya actuado cumpliendo órdenes impartidas por un superior, lo cual a su vez plantea la pregunta por la eventual responsabilidad correlativa de éste.

Translated abstract

Based on a case that has recently captured the attention of public opinion, this work analyses various issues involved in the attribution of criminal liability in relation to offences committed by repressive agents of the Military Regime. These issues refer to, on the one hand, the ques-tion of appealing to a generic criminal defence such as duress and on the other, the question of appealing to a specific criminal defence relating to the fact that the agent acted in obedience to superior orders, which in time raises the problem of assesing the possible criminal liability of the superior who gave the order.
