Abstract

Resumen El desarrollo tecnológico, al permitirle a la persona la transmisión de contenido audiovisual, generó en las sociedades actuales una nueva forma de intimidad sexual. Como todo acto sexual es susceptible de ser violentado, es como nace la conducta de compartir sin autorización estas imágenes y videos sexuales por medio de las redes sociales. El principal problema es que en Colombia las víctimas no cuentan con un instrumento efectivo para que sus victimarios respondan ante la justicia, es así como esta investigación buscó legislaciones que hayan enfrentado esta problemática, para ver como lidiaron con la misma. En el presente artículo se hará un estudio de cómo los estados de la república mexicana han tipificado y construido el delito de la difusión de material audiovisual con contenido sexual sin consentimiento extrayendo, así como determinando el bien jurídico tutelado, los verbos rectores y los ingredientes, como también las agravantes y penas.

Abstract Technological development has allowed to individuals the transmission of audiovisual content, generating in today's societies a new form of sexual intimacy. As every sexual act is susceptible to being violated, this is how the behavior of sharing these images and sexual videos without authorization through social networks is born. The main problem is that in Colombia victims do not have an effective instrument for their perpetrators to respond to justice, this is how this research sought for legislations that have addressed this problem to see how they dealt with it. In this article, a study will be made of how the states of the Republic of Mexico have classified and constructed the crime of dissemination of audiovisual material with sexual content without consent, extracting, as well as determining, the protected legal right, the governing verbs, the ingredients, as well as aggravating circumstances and penalties.
