Abstract

A partir de la nueva agravante de discriminación prevista en el artículo 12 Nº 21 CPen., el trabajo examina la garantía de la igualdad como derecho y su principal enemigo: la discriminación, sobre la base de una mirada al Derecho penal comparado sobre la protección penal del derecho a no ser discriminado, se intenta desentrañar el fundamento dogmático de la agravante para arribar finalmente a la conclusión de que es la concreción positiva de los denominados delitos de odio y que se debe favorecer una interpretación en tal sentido. También se ocupa de los motivos discriminatorios y su delimitación conceptual, y finalmente en la comunicabilidad de la circunstancia a otros partícipes.

With the stipulation of the new aggravating circumstance of discrimination provided for in article 12 No. 21 of the Criminal Code, this work examines the guarantee of equality as a right and its main enemy: discrimination, based on the Comparative Criminal Law on the legal protection of the right not to be discriminated, it attempts to unravel the dogmatic grounds of said aggravating circumstances to finally reach the conclusion that it is the positive implementation of the so-called hate crimes and that an interpretation of said phenomenon must be encouraged. It also addresses the reasons for discriminating and its conceptual delimitation and finally the communicability of this circumstance to other participants.
