          Abstract

          Resumen Este artículo discute el fenómeno de la objeción de conciencia y algunas características de su práctica utilizando los datos de un estudio realizado en Bogotá (Grupo Médico por el Derecho a Decidir, 2015). A partir de los datos, la autora discute la noción de conciencia para distinguir entre aquellas prácticas que se ajustan a la objeción y aquellas que son barreras de acceso, abordando distintas tesis bioéticas sobre la objeción de conciencia. Finalmente, el artículo propone utilizar los estándares de derechos humanos desarrollados por la Corte Constitucional colombiana en materia de objeción de conciencia, como una solución ética compatible con la tesis de la concesión o el mutuo acuerdo.

          Translated abstract

          Abstract This article discusses the phenomenon of conscientious objection, and some features of its practice, using data recently collected in a KAP (Knowledge, Attitudes and Practices) study conducted in Bogotá (Global Doctors for Choice, 2015). Using the figures, the author discusses, from a bioethical perspective, the idea of conscientious and its centrality for both, the provision and denial of services, emphasizing the first one, and addressing different thesis that have been developed in the bioethics field. Finally, the article proposes the use of the standards developed by the Colombian Constitutional Court in different rulings in relation to conscientious objection as an ethical solution compatible with the social contract theory.

          Resum Aquest article discuteix el fenomen de l'objecció de consciència i algunes característiques de la seva pràctica utilitzant les dades d'un estudi realitzat a Bogotà (Grup Mèdic pel Dret a Decidir, 2015). A partir de les dades, l'autora discuteix la noció de consciència per distingir entre aquelles pràctiques que s'ajusten a l'objecció i aquelles que són barreres d'accés, abordant diferents tesis bioètiques sobre l'objecció de consciència. Finalment, l'article proposa utilitzar els estàndards de drets humans desenvolupats per la Cort Constitucional colombiana en matèria d'objecció de consciència, com una solució ètica compatible amb la tesi de la concessió o el mutu acord.

            Conscientious objection and refusal to provide reproductive healthcare: A White Paper examining prevalence, health consequences, and policy responses

            Global Doctors for Choice-a transnational network of physician advocates for reproductive health and rights-began exploring the phenomenon of conscience-based refusal of reproductive healthcare as a result of increasing reports of harms worldwide. The present White Paper examines the prevalence and impact of such refusal and reviews policy efforts to balance individual conscience, autonomy in reproductive decision making, safeguards for health, and professional medical integrity.

              Conscientious objection, barriers, and abortion in the case of rape: a study among physicians in Brazil.

              In Brazil, to have a legal abortion in the case of rape, the woman's statement that rape has occurred is considered sufficient to guarantee the right to abortion. The aim of this study was to understand the practice and opinions about providing abortion in the case of rape among obstetricians-gynecologists (OBGYNs) in Brazil. A mixed-method study was conducted from April to July 2012 with 1,690 OBGYNs who responded to a structured, electronic, self-completed questionnaire. In the quantitative phase, 81.6% of the physicians required police reports or judicial authorization to guarantee the care requested. In-depth telephone interviews with 50 of these physicians showed that they frequently tested women's rape claim by making them repeat their story to several health professionals; 43.5% of these claimed conscientious objection when they were uncertain whether the woman was telling the truth. The moral environment of illegal abortion alters the purpose of listening to a patient - from providing care to passing judgement on her. The data suggest that women's access to legal abortion is being blocked by these barriers in spite of the law. We recommend that FEBRASGO and the Ministry of Health work together to clarify to physicians that a woman's statement that rape occurred should allow her to access a legal abortion.
