      Amalan Istitabah dalam Perlaksanaan Pemulihan Akidah di Malaysia : Istitabah Practices in the Implementation of Faith Restoration in Malaysia

          Abstract

          Perundangan di Malaysia mempunyai perbezaan prosedur dalam penukaran agama atau pengesahan status agama. Prosedur yang digunakan seperti proses rundingcara akidah atau penasihatan akidah dikenali sebagai istitabah. Prosedur ini bertujuan memujuk pemohon untuk kekal dalam Islam. Di samping itu istitabah menjelaskan kekeliruan agama yang wujud dalam diri pemohon. Begitu juga istitabah ini digunakan untuk kesalahan yang berkait dengan ajaran selain Ahli Sunnah Wal Jamaah. Istitabah juga menggunakan Pusat Bimbingan Akidah sebagai lokasi dikenakan perintah penempatan. Namun begitu terdapat keadaan perlaksanaan istitabah tidak dapat dijalankan berpunca daripada masalah pengurusan, ketidakselarasan arahan dan ketiadaan garis panduan taubat. Justeru itu, objektif kajian ini adalah untuk mengenalpasti amalan istitabah dalam perlaksanaan pemulihan akidah di Malaysia. Kajian dilakukan menggunakan metodologi kualitatif melalui pendekatan temubual dan disokong dengan dokumen berkaitan. Kajian ini dijalankan terhadap amalan istitabah di Pulau Pinang, Negeri Sembilan, Selangor dan Kelantan. Hasil kajian menunjukkan terdapat persamaan dan perbezaan dalam amalan istitabah bagi setiap negeri meliputi proses, modul, pihak yang menjalankan istitabah, tempoh masa istitabah dan tindakan susulan pasca istitabah. Kajian ini diharap dapat menyumbang kepada penambahbaikan kaedah pelaksanaan istitabah di peringkat negeri agar prinsip maqasid syariah dalam aspek pemeliharaan agama di Malaysia diutamakan. There are differences in the legislation procedure of conversion of religious status of applicants among the states in Malaysia. “Istitabah” is one of procedure to consult the applicants regarding their faith. The aim of “Istitabah” is to persuade the applicant to remain in Islam. “Istitabah” process explains to the applicant any confusion regarding the religions. Besides, “Istitabah” used to consult any offenses related to teachings other than Ahli Sunnah wa Jamaah. “Istitabah” uses the Akidah Guidance Center as a location of placement orders. However, there are few situations where the implementation of “Istitabah” cannot be carried out due to management problems, inconsistency of instructions and the absence of guidelines for repentance. Therefore, the objective of this study is to identify the practice of “Istitabah” in the implementation of faith restoration among applicant in Malaysia. The study was conducted using qualitative methodology through interview method and supported by relevant documentation. This study was conducted to know the practice of “Istitabah” in Penang, Negeri Sembilan, Selangor and Kelantan. The results show there are similarities and differences in the practice of “Istitabah” between the state mention, including the process, the module used, the party conducting the process, duration of “Istitabah” and follow-up action of “Istitabah”. We hope this study will contribute to the improvement of the implementation of “Istitabah” at the state level in order to preserve the principles of syariah maqasid in Malaysia.
