          Abstract

          O ensaio reflexivo aborda a morte cerebral e a doação de órgãos situando-as como práticas culturais contemporâneas e tendo como suporte teorizações que problematizam o corpo e o sujeito na pós-modernidade, especialmente estudos pós-estruturalistas. São destacadas as relações entre as dimensões culturais, científicas, filosóficas e jurídicas que constituem um campo de contestações e negociações, onde se dão as decisões, normas e aparatos tecnológicos em torno da morte, doação e transplante de órgãos.

          Translated abstract

          This reflexive essay approaches brain death and organ donation, establishing both as an contemporary cultural practice. It is based on the theorization that argues for the body and the subject in the postmodernism, especially in post structural studies. This study also highlights the relationships between cultural, scientific, philosophical and legal dimensions that constitute a field of contestation and negotiation in which the decisions are made towards norms and technological devices concerning death, organ donation and organ transplantation.

          El ensayo reflexivo trata sobre la muerte cerebral y la donación de órganos situándolas como prácticas culturales contemporáneas, cuyo soporte está en las teorizaciones que problematizan el cuerpo y el sujeto en la post-modernidad, en especial los estudios post-estructuralistas. Se destacan las relaciones entre las dimensiones culturales, científicas, filosóficas y jurídicas, quienes constituyen un campo de contestaciones y negociaciones, en donde ocurren las decisiones, las normas y los aparatos tecnológicos respecto a la muerte, donación y el trasplante de órganos.

            Death in technological time: locating the end of meaningful life.

            This article demonstrates how debate about technologically manipulated death is elaborated in radically different forms in the scientifically sophisticated spaces of Japan and North America. Using recent historical materials and contemporary medical, philosophical, and media publications, I argue that the institutionalization and legitimization of "brain death" as the end of life in North America have been justified by a dominant discourse in which it is asserted that if certain measurable criteria are fulfilled, an individual can be declared scientifically dead. In Japan, by contrast, death is interpreted primarily as a social and not an individual event, and efforts to scientifically define the end of life as a measurable point in time are rejected outright by the majority, including many clinicians. The margins between nature and culture are debated in both cultural spaces, but assigned different moral status in the respective dominant discourse.
