          Abstract

          Resumen Durante los últimos quince años, el discurso gubernamental sobre inmigración de gran parte de los estados en Sudamérica se ha vuelto cada vez más liberal con un claro énfasis en los derechos de los migrantes y en la promoción de la movilidad humana de carácter universal. El presente trabajo se interroga sobre si la liberalización en el discurso político sudamericano equivale a una simple paradoja de recibir de manera oficial a todos los inmigrantes mientras que al mismo tiempo se rechazan a ciertas nacionalidades o categorías, o si, por el contrario, nos encontramos ante un giro liberal en las políticas y legislaciones de inmigración en la región, con importantes consecuencias a nivel comparado y que pueda servir como ejemplo a otras regiones del mundo.

          Translated abstract

          Abstract During the last fifteen years, the governmental discourse on immigration from most countries in South America has become more liberal and with a clear emphasis on migrant rights and on the promotion of auniversal human mobility. The present work questions if this liberal political discourse on South American immigration is simply a paradox in which all immigrants are officially welcome, but, at the same time, certain nationalities or categories are rejected, or if, on the contrary, there has actually been a liberal shift in the policies and legislations on immigration in the region, with important comparative consequences and that can serve as an example to other regions of the world.

          Why Liberal States Accept Unwanted Immigration

          This article explores why liberal states accept unwanted immigration, discussing the cases of illegal immigration in the United States and family immigration in Europe. Rejecting the diagnosis of state sovereignty undermined by globalization, the author argues that self-limited sovereignty explains why states accept unwanted immigration. One aspect of self-limited sovereignty is a political process under the sway of interest-group politics (“client politics,” as Gary Freeman says). The logic of client politics explains why the United States accepts illegal immigration. The case of family immigration in Europe suggests two further aspects of self-limited sovereignty: legal-constitutional constraints on the executive, and moral obligations toward historically particular immigrant groups. However, these legal and moral constraints are unevenly distributed across Europe, partially reflecting the different logics of guest worker and postcolonial immigration regimes.
