Abstract

A través de la descripción y análisis de casos, se pretende, en este artículo, mostrar las barreras de acceso a los abortos no punibles (consagrados en el Código Penal desde 1921) en Argentina. Los discursos de los actores implicados en la medicina, la justicia y el estado en general, comparten una concepción esencialista sobre "la mujer" (influida por el fundamentalismo católico) en la que se considera a la maternidad como destino natural e indiscutible, restringiéndose así el acceso a los derechos sexuales y reproductivos. Por otra parte, abordamos también la situación actual en torno a la legalización del aborto.

Translated abstract

Through the description and analysis of cases, is intended to, in this article, show the barriers of access to non punishable abortion (enshrined in the criminal code since 1921) in Argentina. The speeches of the actors involved in medicine, justice and State in general, share an essentialist conception on "women" (influenced by the Catholic fundamentalism) in which are regarded as natural and indisputable destination maternity thus restricting the access to sexual and reproductive rights. On the other hand, we are also dealing with the current situation on the legalization of abortion.
