Abstract

En el mundo global se construyen las bases legales para el reconocimiento de la importancia de los patrimonios culturales y su conservación a través de la participación activa de sus comunidades. El trabajo tiene por objetivo hacer una reflexión del marco jurídico venezolano que ha dado la oportunidad a las comunidades locales, en particular a los pueblos indígenas, de participar en la toma de decisiones sobre el reconocimiento, reestructuración y conservación de su patrimonio cultural. Desde una perspectiva antropológica se hace una lectura del marco jurídico-político que protege los derechos patrimoniales indígenas con miras a describir e interpretar las respuestas de las comunidades. Para el análisis se toma como referente la legislación venezolana a partir de 1999 y las comunidades indígenas wayuu del estado Zulia. Se concluye que es esencial que los pueblos indígenas en su interrelación institucional con el Estado construyan y apliquen las medidas de protección de su patrimonio cultural, teniendo en cuenta las oportunidades económicas y las opciones ecológicas disponibles en las diferentes áreas donde habitan.

In the global world, legal bases for recognizing the importance of cultural patrimonies and their conservation are built through active community participation. The objective of the study is to reflect on the Venezuelan judicial framework that has given opportunity to local communities, particularly to the indigenous peoples, to participate in decision-making on the recognition, restructuring and conservation of their cultural patrimony. From an anthropological perspective, a reading of the judicial-political framework is made that protects indigenous hereditary rights with an eye to describing and interpreting the responses of the communities. For the analysis, Venezuelan legislation since 1999 and the native wayúu communities in the state of Zulia are taken as referents. Conclusions are that it is essential that, in their institutional interrelation with the State, native peoples build and apply protective measures for their cultural patrimony, keeping in mind the economic opportunities and ecological options available in the different areas they inhabit.
