Abstract

Resumen: El objetivo de este trabajo es evidenciar que en Chile no existe una normativa especial que imponga establecer perímetros de protección a las captaciones de agua potable para evitar su contaminación por las actividades potencialmente riesgosas vecinas a tales captaciones. A falta de esta norma especial, se aplica el Código de Aguas (y su nuevo Reglamento del año 2014) que considera un área de protección (fija) para los derechos de aprovechamiento de aguas. Se revisa cómo se determina esta área y cuál es su finalidad, para compararla con la normativa especial de las aguas minerales y las captaciones de agua potable. En síntesis, la regulación del Código resulta insuficiente pues sus normas solo miran a aspectos cuantitativos, de interés del dueño del derecho de aprovechamiento de aguas, pero no sirve para proteger la calidad del acuífero como bien común.

Translated abstract

Abstract: The aim of this paper is to show that in Chile, there isn't a special regulation that imposes the enactment of tap water capture protection areas, for the prevention of water pollution from hazardous activities developed around the capture zone. In the absence of this norm, the Chilean Water Code applies (and its new 2014 bylaw), which considers a fixed protection area for water use rights. The paper examines how this area is determined and what is its purpose, in order to compare it with mineral water and tap water capture's special regulation. In summary, the regulation of the Code is insufficient given that it only considers quantitative aspects, the interest of a water use right's owner, but doesn't focus on protecting the quality of an aquifer as a common good.
