Abstract

Una de las bases del constitucionalismo democrático es la igualdad del voto. Ella puede verse alterada a causa de una viciosa configuración de los territorios electorales para la elección de congresistas. En el caso de Chile, la legislación utiliza la comuna como unidad territorial; lo cual, junto con otras decisiones políticas, han generado diferencias que permiten multiplicar por seis el valor efectivo del voto. La ponencia examinará la situación actual del régimen electoral chileno sobre este tópico y las experiencias comparadas, con el propósito de aportar ideas que pueden disminuir la desigualdad de voto sin afectar otros contenidos de la regulación vigente.

Equality of votes is one of the grounds for democratic constitutionalism. This equality can be altered due to a bad configuration of the electoral territories for congressmen elections. In the case of Chile, the legislation uses the commune as territorial unit; this, together with other political decisions, has generated differences that allow having six times the effective value of the vote. This lecture will examine the current situation of the Chilean electoral system in relation to this matter and the compared experiences in order to give some ideas that may reduce inequality in voting without affecting other contents of the regulation in force.
