          Abstract

          Dentro de los elementos característicos y distintivos del constitucionalismo estadounidense, destaca particularmente el federalismo. Sin embargo, la proposición y luego el establecimiento de un Estado Federal, cuya esfera de autoridad era superior a aquella desempeñada por los poderes públicos estatales, envolvieron un proceso bastante controvertido. Aunque razones de orden práctico impulsaban la creación de una estructura nacional, la idea de soberanía popular -arraigada profundamente en la tradición constitucional presente en cada una de las antiguas Trece Colonias- se interponía al dicho impulso. Las dos posiciones al respecto, la nacionalista y la de los Derechos de los Estados, eventualmente llevaron su causa ante la Corte Suprema de los Estados Unidos. Por ello, la jurisprudencia emanada del alto tribunal durante sus primeras cinco décadas será capital al definir la naturaleza vinculante de la Constitución y del federalismo por ella creado, así como determinará los límites válidos impuestos sobre la soberanía de los Estados.

          Translated abstract

          Among the distinctive elements of American constitutionalism, federalism should be remarked. Yet, both the proposal and establishment of a federal state -whereby its authority was superior to that performed by the state governments- involved a deep controversial process. Although practical reasons supported the creation of a national structure, the notion of popular sovereignty -so deeply attached to the constitutional tradition of the Colonies- comprised an obstacle to said impulse. The two opinions on the issue, both nationalists and those supporting States' Rights, eventually took their cause before the U.S. Supreme Court. Therefore, the jurisprudence of said high tribunal during its first five decades will be pivotal in defining the Constitution's binding character, as well as that of the federalism within it, as it will determine the valid limits imposed upon State sovereignty.
