ملامح أثر التكنولوجيا في تطوير القانون الدولي العام

Abstract

يتناول هذا البحث ملامح التأثير للتقدم العلمي والتكنولوجي في تقييد بعض القواعد والقوانين الدولية، او في تطويرها. فقد كان للثورة التكنولوجية دور واضح في تقييد بعض القواعد المتعلقة بمبدأ السيادة، او مبدأ حرية البحر العام، او حرية استغلال المواد الطبيعية في بعض المناطق البحرية، او حرية التجارة الدولية، أو حرية استخدام القوة. كما كان لها دور في تقييد بعض حقوق الانسان وحرياته الأساسية، أو في تقليص دور البعثات الدبلوماسية. وعلى العكس من ذلك كان للتقدم العلمي والتكنولوجي اسهام في توسيع نطاق القانون الدولي العام، وفي استحداث مفاهيم قانونية دولية جديدة.

Abstract

This research deals with the effects of scientific and technological progress in restricting or developing some international rules and laws. The technological revolution has had a clear role in restricting certain rules relating to the principle of sovereignty, the principle of public freedom of the sea, the freedom to exploit natural materials in certain maritime areas, the freedom of international trade or the freedom to use force. It has also played a role in restricting certain human rights and fundamental freedoms, or in reducing the role of diplomatic missions. On the contrary, scientific and technological progress has had contributed to the expansion of public international law and to the development of new international legal concepts
