          Abstract

          El presente artículo se dirige a analizar la implícita incorporación del derecho al acceso al agua potable en el nuevo Código Civil y Comercial de la Nación Argentina. La tesis que se defenderá es que si bien se eliminó la referencia explícita a tal derecho en el texto definitivo, no solo se ha incorporado el derecho al agua potable en virtud de la incorporación del "bloque federal de constitucionalidad" como una de las fuentes del derecho que recoge el Nuevo Código. Sin desmerecer esto último, en este trabajo se sostendrá la idea de que se habría reconocido implícitamente el derecho al acceso al agua potable en razón del reconocimiento de la inviolable dignidad de la persona humana y de los "derechos de incidencia colectiva".

          Translated abstract

          This articles aims at analyzing the human right to access to drinking water in the New Civil and Commercial Code of Argentina. The central claim to be defended is that even an explicit exclusion of the access to water as a human right in the former Code, the former human right was implicitly incorporated in the New Civil Code not only by the recognition of the Treaties of Human Rights ratified by Argentina as part of the sources of the law to be considered for to settle the cases covered by New Civil and Commercial Code. Without denying the importance of the former, I will hold that the recognition of inviolable dignity of human person and collective rights entailed an implicit incorporation of the access to drinking water as a constitutional right.
