Abstract

RESUMEN El Código Orgánico General de Procesos (COGEP) establece la audiencia como procedimiento para la administración de justicia de manera ágil y eficaz. Este estudio cualitativo de revisión bibliográfica sistematizado a través de los métodos histórico-lógicos, revisión documental, hermenéutica y análisis-síntesis, tiene como propósito desarrollar algunas consideraciones en torno al principio de celeridad procesal y sus consecuencias en la audiencia. Los hallazgos permiten aseverar que la principal novedad del COGEP es la transformación del sistema primordialmente escrito en un juicio por audiencias lo que evitará demoras premeditadas en los procesos, que eran muy propias del modelo escrito; este procedimiento permite hacer efectivo el principio de celeridad que tiene como resultado la estimulación de la correcta aplicabilidad del COGEP trayendo como principal consecuencia que la sociedad vuelva a tener confianza en la administración de justicia cierta, eficiente y humana. Las transformaciones estructurales y procedimentales procesales previstas en el nuevo código no serán posibles sin el cambio mental y moral de los actores de la justicia, abogados, jueces y operadores, y del comportamiento social.

ABSTRACT The General Organic Code of Processes (COGEP) establishes the hearing as a procedure for the administration of justice in an agile and efficient manner. This qualitative study of systematized bibliographical review through historical-logical methods, documentary review, hermeneutics and analysis-synthesis, has the purpose of developing some considerations about the principle of procedural speed and its consequences in the audience. The findings allow to assert that the main novelty of COGEP is the transformation of the system primarily written in a trial by audiences which will avoid deliberate delays in the processes, which were very typical of the written model. This procedure makes possible to implement the principle of celerity that has as a result, the stimulation of the correct applicability of COGEP, bringing as a main consequence that society has confidence in the administration of justice that is true, efficient and human. The structural and procedural transformations foreseen in the new code will not be possible without the mental and moral changes of the actors of justice, lawyers, judges, operators and social behavior.
